Purchase Dates:

The CHEO Dream of a Lifetime Lottery (“CHEO Lottery”) is sponsored by the Children’s Hospital of Eastern Ontario (“CHEO”) Foundation (“Sponsor”). The CHEO Lottery consists of five (5) draws (each, a “Draw”), including four (4) lottery Draws and one (1) 50/50 Draw, and will launch on Wednesday, September 4, 2024 at 12:00 a.m. Eastern Time (“ET”) and end on the final lottery Draw purchase deadline, as set out below (“Purchase Period”):

a)    The purchase deadline for the first lottery Draw (the “First Draw”) is Friday, September 20, 2024 at 11:59 p.m. ET;

b)    The purchase deadline for the second lottery Draw (the “Second Draw”) is Friday, October 25, 2024 at 11:59 p.m. ET;

c)    The purchase deadline for the third lottery Draw (the “Third Draw”) is Friday, November 15, 2024 at 11:59 p.m. ET; and

d)    The purchase deadline for the 50/50 Draw (the “50/50 Draw”) and final lottery Draw (the “Final Draw”) is Friday, December 13, 2024 at 11:59 p.m. ET.

Eligibility:

Ticket (as defined below) buyers must be 18 years of age or older. Ticket buyers must be in the province of Ontario at the time of purchase. For clarity, Tickets may not be purchased in the name of a minor. It is prohibited to mail Tickets outside the province of Ontario.

The following individuals and their immediate family members living at the same address are excluded from participating in the CHEO Lottery, including, without limitation, purchasing a Ticket (as defined below), receiving a Ticket as a gift, and claiming any Prize (as defined below): (a) Sponsor staff and board members; (b) members of licensed gaming suppliers providing services to the CHEO Lottery; (c) partners and staff of Canadian Bank Note Company, Limited; and (d) any other person directly involved in or responsible for the conduct of the CHEO Lottery or involved in the sale of Tickets.

Agreement to be Legally Bound by Rules:

By participating in the CHEO Lottery, you are signifying your agreement that you have read and agree to be legally bound by these Official Rules and Regulations (“Rules”).

Tickets:

Official CHEO Lottery tickets (“Lottery Tickets”) and official CHEO Lottery 50/50 tickets (“50/50 Tickets”, and together with Lottery Tickets, “Tickets”) will be available for purchase during the Purchase Period: (a) online at www.dreamofalifetime.ca; and (b) by phone at 1 (613) 722-5437 or 1 (877) 562-5437. Tickets will be sold using an electronic raffle system supplied by Canadian Bank Note Company, Limited. Tickets can be purchased online (www.dreamofalifetime.ca) from Wednesday, September 4, 2024 until 11:59 p.m. Friday, December 13, 2024. Canadian Bank Note Company, Limited has been contracted for this lottery and is delivering online and phone services. Tickets can be purchased by phone (613-722-5437 or 1-877-562-5437) from Wednesday, September 4, 2024 until 11:59 p.m. Friday, December 13, 2024.

At the start of the Purchase Period, 155,500 total Lottery Tickets will be available, including: (a) 150,000 Lottery Tickets available for purchase; and (b) 5,500 Lottery Tickets available to be won as a Draw prize (each, a “Bonus Lottery Ticket” – see below for prize details). There is no limit to the total number of 50/50 Tickets available.

Tickets are available during the Purchase Period at the following set quantities and purchase prices: (a) 1 x Lottery Ticket for $100; (b) 3 x Lottery Tickets for $250; (c) 1 x 50/50 Ticket for $10; (d) 5 x 50/50 Tickets for $25; (e) 15 x 50/50 Tickets for $50; (f) 5 x Lottery Tickets plus 15 x 50/50 Tickets for $500; (g) 3 x Lottery Tickets plus 15 x 50/50 Tickets for $300; and (h) 1 x Lottery Ticket plus 15 x 50/50 Tickets for $150. Note, purchase of a 50/50 Ticket is only available with purchase of a Lottery Ticket – see below for details.

Ticket buyers will be given the option to receive printed Tickets in the mail or electronic Tickets sent by email (at the e-mail address provided at the time of purchase). No specific Ticket numbers can be given as numbers are generated randomly. The Sponsor and all other Released Parties (as defined below) do not accept any responsibility whatsoever for Ticket(s) not received for any reason. Each purchaser is solely responsible for ensuring that their correct mailing or email address (as applicable) is provided for delivery. If purchasers do not receive their Ticket(s) within five (5) business days by email or within fifteen (15) business days by mail (as applicable) from the time their order was placed, customer service may be contacted by calling 1 (877) 562-5437 or by emailing [email protected]  and, the Sponsor may, at its sole and absolute discretion, however is under no obligation to, replace such Ticket(s) not received. Please note that delivery during Purchase Period may be delayed due to higher volume of orders.  

Ticket purchases are not tax deductible. All Tickets purchased as a package must contain the same names and mailing address. Tickets purchased as a package can only be issued to the address of the primary Ticket holder (which is the first name appearing on the Ticket). Payment must be received in full for the Ticket purchase to be valid. In the event of an invalid cheque or credit card, Tickets issued will be considered invalid. Ticket distribution and Draw control will be conducted by the professional services firm, Canadian Bank Note, Limited. All inquiries regarding the chances of winning shall be made to the Sponsor prior to the purchase of Ticket(s). Important Note – 50/50 Ticket Purchases: Purchase of a 50/50 Ticket is only available with purchase of a Lottery Ticket. 50/50 Ticket orders will not be accepted without ordering a Lottery Ticket. 50/50 Tickets can be ordered in conjunction with Lottery Ticket orders (as set out above), or at any time before the end of the Purchase Period with proof of a Lottery Ticket purchase including a valid receipt number. To order any 50/50 Ticket(s) after completing an initial Lottery Ticket purchase, customer service must be contacted by calling 1 (877) 562-5437 or by emailing [email protected] Should an original Lottery Ticket order become invalid, any and all 50/50 Tickets associated with such original Lottery Ticket order will also become invalid as a direct result.  

Important Note – Group Purchases: ALL PRIZES WILL BE AWARDED IN THE NAME OF THE PRIMARY TICKET HOLDER ONLY, WHICH IS THE FIRST NAME APPEARING ON THE TICKET. The Sponsor will not involve itself in, and the Released Parties (as defined below) accept no obligation or liability in respect of, any decision regarding a primary Ticket holder’s subsequent distribution, allocation, use or misuse of a Ticket or Prize (as defined below). Without limiting any of the foregoing, groups may purchase Tickets, however a maximum of three (3) names can appear on a Ticket. Group members must work out the details of payment and, as applicable, Prize collection among themselves. The Sponsor and all other Released Parties will not play any role in settling any disputes relating to group Ticket purchases.  

Participation Conditions and Verification:

To be eligible, Tickets much be purchased in accordance with these Rules during the Purchase Period and your participation must be in accordance with these Rules. If it is discovered by the Sponsor (using any evidence or other information made available to or otherwise discovered by it) that any person has attempted to disrupt or participate in the CHEO Lottery in any fraudulent or misleading way, then they may be disqualified from the CHEO Lottery in the sole and absolute discretion of the Sponsor. The Sponsor, CHEO, Canadian Bank Note, Limited, their respective affiliates, and the organizations, prize suppliers, advertising/promotion agencies and any other individual(s) or entity(ies) involved in the development, production, implementation, administration or fulfilment of the CHEO Lottery, and each of their respective agents, employees, directors, officers, successors, members, assigns and other representatives (collectively, “Released Parties”) are not responsible for, and accept no liability whatsoever in relation to, any late, lost, misdirected, delayed, incomplete or incompatible Tickets, Ticket purchase attempts, and/or any other CHEO Lottery-related information (collectively, “CHEO Lottery-Related Information”), all of which are void.

All CHEO Lottery-Related Information and participants are subject to verification at any time and for any reason. The Sponsor reserves the right, in its sole and absolute discretion, to require proof of identity and/or eligibility (in a form acceptable to the Sponsor, including, without limitation, government issued photo identification): (a) for the purposes of verifying a participant’s eligibility to participate in the CHEO Lottery; (b) for the purposes of verifying the eligibility and/or legitimacy of any CHEO Lottery-Related Information and/or any other information provided (or purportedly provided) for the purposes of the CHEO Lottery; and/or (c) for any other reason the Sponsor deems necessary, in its sole and absolute discretion, for the purposes of administering the CHEO Lottery in accordance with the letter and spirit of these Rules. Failure to provide such proof to the complete satisfaction of the Sponsor within the timeline specified by it, may result in disqualification in the sole and absolute discretion of the Sponsor.

Draws and Prizes:

First Draw: The First Draw will be held on Wednesday, October 2, 2024. During the First Draw, the Sponsor will select one (1) Lottery Ticket number, from among all eligible Lottery Tickets purchased on or before the First Draw purchase deadline set out above, to be a First Prize winner. The “First Prize” consists of either (a) a 2024 F150 from Lincoln Heights Ford (with a total approximate retail value of $88,250), (b) a Yamaha 195S Sport Boat from Hurst Marina (with a total approximate retail value of $89,900), or (c) $100,000 cash, as chosen by the First Prize winner. The odds of winning depend on the number of Lottery Tickets purchased on or before the First Draw purchase deadline.

Second Draw: The Second Draw will be held on Wednesday, October 30, 2024. During the Second Draw, the Sponsor will select eleven (11) Lottery Ticket numbers, from among all eligible Lottery Tickets purchased on or before the Second Draw purchase deadline set out above, to be Second Prize winners. The “Second Prize” consists of ten (10) draws for a pair of tickets to see Seinfeld and Gaffigan at the Canadian Tire Centre, plus $5,000 in cash (with a total approximate retail value of $5,219.30 each), as well as one (1) draw for a pair of front row tickets to see Seinfeld and Gaffigan at the Canadian Tire Centre, one night accommodations for two (2) at the Brookstreet Hotel, plus $50,000 cash (with a total approximate retail value of $51,621.10). The odds of winning depend on the number of Lottery Tickets purchased on or before the Second Draw purchase deadline.

Third Draw: The Third Draw will be held on Wednesday, December 4, 2024. During the Third Draw, the Sponsor will select 5,501 Lottery Ticket numbers, from among all eligible Lottery Tickets purchased on or before the Third Draw purchase deadline set out above, to be Third Prize winners. The “Third Prize” consists of 5,500 draws for one (1) Bonus Lottery Ticket (with a total approximate retail value of $100 each), as well as one (1) draw for $250,000 cash. The odds of winning depend on the number of Lottery Tickets purchased on or before the Third Draw purchase deadline.

50/50 Draw: The 50/50 Draw will be held on Monday, January 6, 2025. During the 50/50 Draw, the Sponsor will select one (1) 50/50 Ticket from among all eligible 50/50 Tickets purchased on or before the 50/50 Draw purchase deadline set out above, to be a 50/50 Prize winner. The total value of the 50/50 Prize drawn is dependent on the total number of 50/50 Tickets sold. The “50/50 Prize” consists of a cash prize, in an amount that is equal to fifty percent (50%) of the total 50/50 Ticket sales for the CHEO Lottery collected by the Sponsor during the Purchase Period (the value of the Draw Prize shall be determined by the Sponsor, in its sole discretion, on the basis of its official 50/50 Ticket sales records). The odds of winning depend on the number of 50/50 Tickets purchased on or before the 50/50 Draw purchase deadline. The confirmed Draw Prize winner will be given a cheque or electronic funds transfer in the amount of the declared 50/50 Prize value.

Final Draw: The Final Draw will be held on Monday, January 6, 2025. During the Final Draw, the Sponsor will select 2,774 Lottery Tickets from among all eligible Lottery Tickets purchased on or before the deadline set out above, starting from the lowest value to the highest value in prizes with the 50/50 then the Grand Prize being drawn. The “Grand Prize” consists of a Minto Dream Home fully furnished by La-Z-Boy Home Furnishings and Décor; $100,000 cash; a Mercedes-Benz EQB 300 4Matic SUV or $69,249 cash (as chosen by the Grand Prize winner); $5,000 gas card from W.O. Stinson and Son; bi-weekly house cleaning for one (1) year from ATC Cleaning; a $5,000 Farm Boy gift card; moving services from Adam’s Moving; and related legal services from Mann Lawyers LLP. The total approximate retail value of the Grand Prize is $3,364,152.15. The odds of winning depend on the number of Lottery Tickets purchased on or before the Final Draw purchase deadline.

Each winning Ticket selected in a Draw will carry over into and be eligible in any subsequent Draw(s) in the CHEO Lottery (as determined by the Sponsor at its sole discretion). All Draws will be conducted at the offices of Canadian Bank Note, Limited. All Draws will be made using random number generator software under the supervision of Canadian Bank Note, Limited. Draw records held by Canadian Bank Note, Limited shall be deemed correct, final and binding on all participants without right of appeal.  

The winning Ticket numbers will be posted at www.dreamofalifetime.ca by Tuesday, January 7, 2025. The general public is welcome to attend the Draws. Please contact the offices of Canadian Bank Note, Limited at 18 Auriga Drive, Ottawa, ON, K2E 7T9 to inquire if such visits are permitted based on any applicable local, provincial or federal restrictions due to public health guidance at the time of an applicable Draw.  

Each First Prize, Second Prize, Third Prize, 50/50 Prize and Grand Prize (each, a “Prize”) are subject to the applicable Prize terms and conditions set out below. Winners will be notified in writing by mail by Canadian Bank Note, Limited as to what Prize they have won and where to claim their Prize. Winners must have the original winning Ticket number and photo identification in order to claim their Prize.

All Prizes must be claimed on or before January 7, 2026. If, as of such date, any Prizes have still not been claimed, the Prize or monies equivalent to the fair market value of the Prize will be donated to a beneficiary approved by the applicable licensing authority.

If a potential winner does not accept (or cannot accept or is unwilling to accept) a Prize, as awarded, for any reason, and/or is determined to be in violation of these Rules (all as determined by the Sponsor in its sole and absolute discretion), then they will be disqualified and forfeit all rights to the applicable Prize.

The following terms and conditions apply to each Prize: (a) the Prize must be accepted as awarded and is not convertible to cash (except as may be specifically permitted by the Sponsor in its sole and absolute discretion); (b) winners may transfer their Prize; (c) no substitutions are permitted, except at the Sponsor’s option (the Sponsor reserves the right to substitute a Prize, in whole or in part, in the event that all or any component of such Prize is unavailable with a prize or prize component(s) of equal or greater retail value, including, without limitation, but solely at the Sponsor’s sole discretion, a cash award); (d) all characteristics and features of the Prize, except as otherwise explicitly stated above, are at the Sponsor’s sole and absolute discretion; (e) the Prize winner is solely responsible for all costs not expressly described herein; (f) the Sponsor will require, in its sole and absolute discretion, that an eligible winner sign and return its form of declaration and release prior to being confirmed as a winner; (g) Prize values are based on retail values at the time of CHEO Lottery license application (under no circumstances whatsoever will any difference between the actual retail value of a Prize as at the time of fulfilment and the approximate retail value of the Prize noted above be awarded); (h) the Released Parties will not, in any way, be responsible (and for greater certainty, are not obligated to offer any substitute prizing) in the event that any part of a Prize is delayed, postponed, re-scheduled or cancelled for any reason whatsoever; and (i) if a confirmed winner does not utilize any part(s) of a Prize, then any such part(s) not utilized may, in the sole and absolute discretion of the Sponsor, be forfeited in their entirety and, if forfeited, nothing will be substituted in their place.

Without limiting any of the foregoing, the following additional terms and conditions apply to the First Prize vehicle (“Vehicle”) if chosen by the eligible First Prize winner: (a) the Vehicle trim, colour and other specifics will be selected at the Sponsor’s sole discretion (and is subject to available inventory); (b) the Vehicle will not be released unless and until the confirmed winner first shows, if applicable, proof (in a form acceptable to the Sponsor) of having a valid driver’s licence (equivalent to a full “G” class licence in Ontario) and proof (in a form acceptable to the Sponsor) of satisfactory insurance; (c) in the event that the eligible First Prize winner does not, if applicable, have a valid driver’s licence or is not legally eligible to operate the Vehicle, the eligible First Prize winner may be permitted to transfer the First Prize to an individual who meets the necessary requirements as specified in these Rules; and (d) the Vehicle will, if chosen, be awarded at a dealership selected by the Sponsor in its sole discretion (it is the sole and absolute responsibility of the confirmed First Prize winner to arrange for their own transportation and/or accommodations, as applicable, to and from the applicable dealership).

General Conditions:

The decisions of the Sponsor with respect to all aspects of this CHEO Lottery, including, without limitation, the eligibility of participants or any CHEO Lottery-Related Information, are final and binding on all participants without right of appeal. The sole determinant of the time for the purposes of the CHEO Lottery will be the official time-keeping device(s) used by the Sponsor. Anyone deemed by the Sponsor to be in violation of the Sponsor’s interpretation of the letter and/or spirit of these Rules for any reason is subject to disqualification in the sole and absolute discretion of the Sponsor at any time. 

All CHEO Lottery-Related Information becomes the property of the Sponsor. The Released Parties will not be liable for: (a) any failure of any website or platform during the CHEO Lottery; (b) any technical malfunction or other problems of any nature whatsoever, including, without limitation, those relating to the telephone network or lines, computer on-line systems, servers, access providers, computer equipment or software; (c) the failure of any CHEO Lottery-Related Information, winner notification message and/or other information to be received, captured or recorded for any reason whatsoever, including, but not limited to, technical problems or traffic congestion on the Internet or at any website; (d) any injury or damage to a participant’s or any other person’s computer or other device related to or resulting from participating in the CHEO Lottery; (e) anyone being incorrectly and/or mistakenly identified as a winner or eligible winner; (f) any liability caused, in whole or in part, by any act of God, fortuitous event or force majeure; and/or (g) any combination of the above.

The Sponsor reserves the right, in its sole and absolute discretion, to cancel, withdraw, amend or suspend the CHEO Lottery (or to amend these Rules) in any way, without prior notice or obligation, in the event of any cause beyond its reasonable control that interferes with the proper conduct of the CHEO Lottery as contemplated by these Rules, including, without limitation, any error, problem, computer virus, bugs, tampering, unauthorized intervention, fraud or failure of any kind whatsoever, in the event of any accident, printing, administrative or other error of any kind, or for any other reason whatsoever. Any attempt to undermine the legitimate operation of the CHEO Lottery in any way (as determined by the Sponsor in its sole and absolute discretion) may be a violation of criminal and civil laws and should such an attempt be made, the Sponsor reserves the right to seek remedies and damages to the fullest extent permitted by law. The Sponsor reserves the right, in its sole and absolute discretion, to adjust any of the dates, timeframes and/or other CHEO Lottery mechanics stipulated in these Rules, to the extent deemed necessary by the Sponsor, for the purposes of verifying compliance of any participants, CHEO Lottery-Related Information and/or other information with these Rules, or as a result of any technical or other problems, or in light of any other circumstances which, in the opinion of the Sponsor, in its sole and absolute discretion, affect the proper administration of the CHEO Lottery as contemplated in these Rules, or for any other reason.

By participating in the CHEO Lottery, each participant expressly consents to the Sponsor, CHEO and their respective agents and/or representatives, storing, sharing and using the personal information submitted by them, only for the purpose of administering the CHEO Lottery and in accordance with the Sponsor’s privacy policy (available at: https://cheofoundation.donordrive.com/index.cfm?fuseaction=donorDrive.privacy). Without limiting the generality of the foregoing, all winners hereby agree and consent to the use of their name and photo for publicity purposes by the Sponsor. This section does not limit any other consent(s) that an individual may provide the Sponsor, CHEO or others in relation to the collection, use and/or disclosure of their personal information.

In the event of any discrepancy or inconsistency between the terms and conditions of these Rules and disclosures or other statements contained in any CHEO Lottery-related materials, including, but not limited to, point of sale, television, print or online advertising and/or any instructions or interpretations of these Rules given by any representative of the Sponsor, the terms and conditions of these Rules shall prevail, govern and control to the fullest extent permitted by law. For clarity, the English language version of these Rules shall be the original, governing instrument. Although these rules are also available in French, the English language version shall govern and control in the event of any discrepancy or inconsistency.

The invalidity or unenforceability of any provision of these Rules shall not affect the validity or enforceability of any other provision. In the event that any provision is determined to be invalid or otherwise unenforceable or illegal, these Rules shall otherwise remain in effect and shall be construed in accordance with the terms as if the invalid or illegal provision were not contained herein. To the fullest extent permitted by applicable law, all issues and questions concerning the construction, validity, interpretation and enforceability of these Rules or the rights and obligations of participants, the Sponsor or any of the other Released Parties in connection with the CHEO Lottery will be governed by and construed in accordance with the laws of the Province of Ontario and the laws of Canada applicable therein, without giving effect to any choice of law or conflict of law rules or provisions that would cause the application of any other jurisdiction’s laws. The parties consent to the exclusive jurisdiction and venue of the courts located in Ontario in any action to enforce (or otherwise relating to) these Rules or relating to the CHEO Lottery.
